You Can Settle Medical Malpractice Cases Without An AttorneyInjured people can settle their own medical malpractice cases without an attorney. However, I would suggest that you try to settle your claim only if it is a very small claim or you are not able to get a lawyer to handle your case. If you have a "normal" medical malpractice case with serious injuries, you need to hire an attorney. A small medical malpractice claim is where your injury is fairly minor and it is clear that the medical care provider did something wrong and caused your injury. If you feel strongly that medical malpractice was committed against you and after talking to a number of attorneys, if no attorney will take your case, you may as well go ahead and pursue it yourself. If you do want to try to settle you own medical malpractice claim, be sure to gather together copies of all medical records (doctor, hospital, etc.) and bills. Note: Hospitals are notorious for not giving people copies of all records. Generally, they will leave out nurses notes and lab results. Make very sure that you get the complete and full medical records. You need to know all about your case (what happened and why there was medical malpractice) so that you can tell the insurance adjuster (medical malpractice insurance companies use adjusters just like automobile insurance companies do) why you believe that you are entitled to compensation and why you believe that you are entitled to a certain dollar amount as compensation. When you know all about your case, you can determine easier if the insurance adjuster is misrepresenting any facts and correct the information. When you do not know all about your case, the insurance adjuster may misrepresent some facts and BS you into accepting less compensation.
